And any other Documents used in the process of planning The Local Plan ,HLSMA - SHELAA - SHMA- DPDs - SPDs - SEAs - HRA - SEA - Sustainability Appraisals, SFRA Lead Local Authority Flood documents Etc.
An extract from The Local Government Lawyer. Department for Communities and Local Government- Publishes final version of the National Planning Practice Guidance- Friday 7th March 2014.In a written ministerial statement, Planning Minister Nick Boles said planning "should not be the exclusive preserve of lawyers, developers or town hall officials". Boles highlighted how government was -
"issuing robust guidance on flood risk, making it crystal clear that councils need to consider the strict tests set out in national policy, and where these are not met, new development on flood risk sites should not be allowed".
It doesn't look like SBC Forward planning officers are following these principles.
WHO MONITORS THE MONITOR - WHO ASSESSES THE ASSESSORS
It is up to us ,
The Residents and others to highlight any issues, discrepancies, conflict or errors in the assessments for Site HA23 now HA24.
We have scrutinised these assessments with the help of independent qualified professionals and found just that.
It is important to follow and maintain the integrity of the Planning Process
Since the first public meeting at Filey Town Council offices on 1st September 2014.
SBC planning officers have taken and continued with an arrogant we know better attitude towards
Filey residents who dare question them.
In the evolution of the SBC Local Plan and the issues raised in reference to Site HA21/23/24 by Filey residents
SBC have ignored these issues or have latter altered/fudged its documentation when critical points have been raised.
Post examination in public the Site HA23 now HA24 still remains in the plan.
So what will happen now?
Will the Landowner develop the site or sell?
Will the buyer a developer take on the risk associated with this site? if so.
We wait for a planning application for development on the site
Residents will have to check regularly on the Scarborough Borough Council Planning Portal Website
to see if a planning application has been submitted for this site.
when an application does come in and you want to object to development on site HA24 Land off Church Cliff Drive. Filey.

Finally residents do not want another Mill Meadows Estate Fiasco.
The development company Coast and Country (Community Benefit Society) has gone dust.
Leaving the estate half finished and looking like a building site.
The new Residents are furious.
It seems the viability model for this development has not been robust enough with disastrous consequences.
The issues now are will the S106 agreements for the development come to fruition?
i.e. the playing field /sports area for the community , plus any other items agreed for the communities benefit ?
It looks like Filey residents and the community could come out losers?
as the additional agreed benefits for the community may NOT happen now?

Here the developer stood the cost of the flood alleviation for this area of the town, part of the planning deal.
Looks like SBC are in pursuit of the same outcome for Site HA23 ( breaching policies and laws in the process)
Off loading the Flood Alleviation Scheme responsibility and construction cost onto the Developer.
Potentially saving SBC large amounts of money,
The Flood Alleviation Scheme money has already been granted by central government and regional flood funding bodies
and planning has been passed for the Filey Flood Alleviation Scheme work to commence,
Was planned to start march 2017. NOW ON HOLD . WHY?
This three year agreed planning period for FFAS ends December 2018.
